Welcome to Conception Web Montréal. By accessing and using our website and services, you agree to comply with the following terms and conditions:

Payment Terms: Payment for our services is due upon receipt of the invoice. We reserve the right to suspend or terminate services for non-payment.

Limitation of Liability: We are not liable for any damages arising from the use of our services, including direct, indirect, incidental, or consequential damages.

Termination: We reserve the right to terminate or suspend access to our services at any time, with or without cause or notice.

Governing Law: These terms and conditions are governed by the laws of Quebec, Canada. Any disputes will be resolved in the courts of Quebec.

Hosting Terms of Use

By using the hosting services provided by Conception Web Montréal, you ("Client") agree to comply with the following terms of use. These terms govern the use of hosting services, which are offered through a reseller relationship with WHC.CA.

1. Hosting Services Overview

Conception Web Montréal offers website hosting services that include:

• Hosting for up to 3 websites
• Unlimited disk space and traffic (subject to reasonable use)
• 5 email accounts
• SSL certificates
• AI Site Builder, Content Creator, and WordPress Assistant
• Domain registration (1 free domain)
• Email marketing tool (1,000 contacts)
• Powered by renewable energy
• Backup and restore services (1-click restore feature)
• WordPress optimization

2. Pricing and Payment

The annual cost for hosting services is $300 CAD, payable in advance. All payments are non-refundable unless explicitly stated otherwise.

3. Service Renewal

Hosting services will automatically renew on an annual basis unless canceled by the Client in writing at least 30 days before the renewal date.

4. Client Responsibilities

By using our hosting services, the Client agrees to:

• Ensure that all website content complies with applicable laws and regulations, including Canadian privacy laws such as PIPEDA and CASL.
• Keep all website software, plugins, and security measures updated.
• Use secure passwords and maintain the security of their account.

5. Limitation of Liability

Conception Web Montréal is a reseller of hosting services provided by WHC.CA and does not control the hosting infrastructure. Conception Web Montréal’s total liability for any damages related to the hosting services will not exceed the total amount of fees paid by the Client during the 12-month period prior to the claim.

Conception Web Montréal will not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, loss of data, business interruptions, or issues caused by third-party providers such as WHC.CA.

Client is responsible for securing their own data through proper backups and for implementing website-level security (e.g., plugins, passwords). Conception Web Montréal shall not be held liable for any data breaches caused by vulnerabilities within the Client’s website.

6. Termination of Services

Conception Web Montréal reserves the right to terminate or suspend hosting services for non-payment or violation of the terms of use.

Upon termination, the Client is responsible for transferring their websites and data to another service provider. Conception Web Montréal will assist in the transfer process, subject to applicable fees.

7. Force Majeure

Conception Web Montréal will not be held liable for failure to perform its obligations due to circumstances beyond its control, including acts of God, hacking, power outages, equipment failure, labor disputes, or other external forces beyond the Provider’s control.
